PHOTOSALES AGREEMENT
This Photosales Agreement ("Agreement") governs purchase via
this website of photographs taken from the newspapers New Straits Times,
New Sunday Times, Berita Harian, Berita Minggu, The Malay Mail, Sunday
Mail, Harian Metro and Metro Ahad (NSTP’s Group of Publications”).
This Agreement is comprised of: this document; the general terms and conditions
at www.e-media.com.my (in respect of NSTP’s Group of Publications)("General
Terms and Conditions").
In the event of any inconsistency between the terms of this document
and the General Terms and Conditions, this document shall prevail. Please
read all parts of this Agreement carefully before using this website.
By accessing this website, you agree and acknowledge that you have read
all parts of this Agreement.
GENERAL RULES AND DEFINITIONS
- This website is operated by NSTP e-Media Sdn Bhd ("E-MEDIA"), which
is owned by The New Straits Times Press (Malaysia) Berhad (Co. No. 4485-H)
("NSTP") to sub-license the various intellectual property rights of
NSTP. The registered address of E-MEDIA is Balai Berita, No. 31 Jalan
Riong, 59100 Kuala Lumpur.
- Access to and purchase of photographs from this website is provided
by E-MEDIA subject to this Agreement and by accessing and using this
website you accept in full this Agreement and agree to comply with it
in your use of the website.
- This Agreement may be modified by E-MEDIA from time to time. Notice
of revisions to this Agreement will be announced on this page. You are
responsible for reviewing regularly this page to obtain timely notice
of such changes. Continued use of this website shall constitute your
acceptance of any changes or revisions to this Agreement.
- E-MEDIA provides this website on an "as is" basis. To the extent
permitted by any applicable law, E-MEDIA makes no representations or
warranties of any kind as to :
- the website or the availability of the website for access and
use;
- the accuracy, completeness or suitability for any purpose of any
of the content on the website.
- Any liability, however it occurs, for any inaccuracies or errors on
this website is expressly excluded to the fullest extent permitted by
any applicable law. If a term is implied into this Agreement by any
applicable law and the applicable law prohibits provisions in a contract
excluding or modifying liability under that term, then it will be deemed
to be included in this Agreement.
- PHOTOGRAPHS PURCHASED ON THIS WEBSITE MAY ONLY BE USED FOR PERSONAL
USE. The photographs contained in this website cannot be reproduced,
republished, resold, transmitted, modified or developed in any form
whatsoever for commercial purposes without E-MEDIA's express prior permission
in writing. E-MEDIA owns all rights in this site and reserves its right
totally in the event of any violation of copyright law and other proprietary
rights.
PAYMENT
- You agree to pay all charges incurred in respect of photographs you
buy from this website.
- All charges are non-refundable. If you have queries in relation to

CHOICE OF LAW AND JURISDICTION
- You agree that this Agreement, for all purposes, shall be governed
by and construed in accordance with, Malaysian law. You also agree,
subject to the following clause, to submit to the exclusive jurisdiction
of the Malaysian courts as regards any claim or matter arising under
this Agreement.
- E-MEDIA shall retain the right to bring proceedings in the courts
of the country of your residence.
GENERAL
You may not assign, sub-licence or otherwise transfer any of your rights
under this Agreement. If any part of this Agreement is found to be invalid
by any court having competent jurisdiction the validity of the remaining
terms will be unaffected. If either party does not exercise any right or
remedy under this Agreement, this will not be taken to mean that such right
or remedy has been waived.
